He gave sperm to a friend and thought we would have an uncle`s relationship with the child. In Ontario, Section 5 of the Child Rights Reform Act provides that a person who provides reproductive material for use in the conception of a child through assisted reproduction is not legally recognized as a parent of the child, unless that person is considered a parent by other parenting rules in the legislation. This means that the donation of multiplication material alone is not sufficient to automatically conclude that the donor is not a parent of the child. It is important to note that intentional parents and sperm donors have separate legal representation. As a general rule, the parents considering will let their lawyer prepare the sperm donor agreement, and the sperm donor will bring the agreement to a separate lawyer for independent legal advice. The sperm donor`s lawyer will follow the agreement with the donor to ensure that he understands how he or she influences his rights and obligations and will negotiate any necessary changes. Having said that, it is risky to rely on an oral agreement or no agreement, especially when there is so much at stake. A donor may be known – that is, the donor is known to the parent, usually a friend or a single-family member. Fifteen years after the Introduction of the Assistant Human Reproduction Act, Health Canada has finally unlocked the long-awaited rules under the Surrogate And Donor Refund Act. Donor is therefore mentally and emotionally prepared to be a successful donor without engaging in the lives of children. There is a case where a sperm donor agreement is required under the Children`s Act, and that is where sperm donation is in relation to sexual intercourse. The law on the applicability of sperm and egg donation agreements remains unexplained in Ontario and in parents who intend to do so, and the donor must understand that these contracts involve a degree of uncertainty.
